A mis-trial was declared in a jury trial that was scheduled to get underway in Henry County Common Pleas Court earlier this week. Curtis Otto of Napoleon was facing a felony charge of Aggravated Trafficking in Drugs. The mis-trial was declared when a juror looked-up the meaning of ‘aggravated’ on their cell phone, when they were instructed by the judge not to seek information from outside the courtroom. A pre-trial conference has been set for tomorrow (Thur.) to determine how this case will proceed. Prosecuting Attorney Gwen Howe Gebers reports she will seek to have a new trial for Otto, if a plea agreement is not reached this week.
